A BILL to amend article ten, chapter eighteen-b of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
seven-b, relating to establishing programs at state
institutions of higher education allowing residents who are
at least sixty-five years old to audit, or take for credit,
classes at reduced rates.
Be it enacted by the Legislature of West Virginia:
That article ten, chapter eighteen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
seven-b, to read as follows:
ARTICLE 10. FEES AND OTHER MONEYS COLLECTED AT STATE
INSTITUTIONS OF HIGHER EDUCATION.
§18B-10-7b. Tuition and fee waivers or adjustments for
residents at least sixty-five years old.
(a) Each state institution of higher education shall
establish a program that allows West Virginia residents who are
at least sixty-five years old to attend its undergraduate and
graduate courses and classes, if classroom space is available and
with the instructor's consent, at reduced tuition and fee rates.
The state institution of higher education may require the person
to pay special fees, including laboratory fees, if the fees are
required of all other students taking a single or the particular
course and may also require the person to pay for parking. The
program shall provide, at a minimum:
(1) No grade or credit be given to persons participating in
the program;
(2) Priority for allowing a participant to take a particular
class or course be given to those applying for the class or
course in chronological order of request; and
(3) The total tuition and fees charged for each course or
class, excluding laboratory and parking fees, does not exceed fifty dollars.
(b) In addition to the program established pursuant to
subsection (a) of this section each state institution of higher
education shall establish a program that allows West Virginia
residents who are at least sixty-five years old to attend its
undergraduate and graduate courses and classes for credit, if
classroom space is available and with the instructor's consent,
at reduced tuition and fee rates. The rates may not exceed fifty
percent of the normal rates charged to state residents by the
institution.
NOTE: The purpose of this bill is to establish programs at
all state institutions of higher education to allow residents who
are at least sixty-five years old to audit, or take for credit,
undergraduate and graduate classes at reduced rates.
